MB Tech Co., Ltd. holds the rights to the Well-Fixed Mobile application (Well-Fixed Mobile).

By downloading, viewing, accessing, or using the Well-Fixed Mobile application (“Well-Fixed Mobile” or “the App”), the user (“User”) agrees to be bound by these Terms and Conditions (“Terms and Conditions”) governing the use of the App (“Use”).

The Company reserves the right to modify these Terms and Conditions at any time. If the User does not agree with any provision of these Terms and Conditions, the User must immediately cease accessing and using the Well-Fixed Mobile application. Continued use of the Well-Fixed Mobile application shall be deemed as the User’s acceptance of these Terms and Conditions, including any modifications or amendments made from time to time.

1. Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meanings set forth below:

1.1 Well-Fixed Mobile refers to the name of the software application developed by MB Tech Co., Ltd. and made available for download via the Google Play Store and App Store.

1.2 User refers to any individual who uses the Well-Fixed Mobile application.

1.3 Terms and Conditions refer to this agreement, including any annexes, supplementary documents, policies, notices, agreements, and other terms related to the use of the website, software, and Well-Fixed Mobile application.

1.4 Use refers to downloading, browsing, accessing, and utilizing the application, regardless of the method, manner, device, or platform used, and whether or not a fee is required.

2. General Provisions Regarding Well-Fixed Mobile

2.1 Enforcement of Terms and Conditions

The use of the Well-Fixed Mobile application is subject to these Terms and Conditions.

2.2 Scope

Well-Fixed Mobile is intended solely for personal use by users and must not be used for commercial purposes or any concealed business-related activities.

2.3 Prohibited Use

The company reserves the right to modify, suspend, or terminate Well-Fixed Mobile, in whole or in part, whether temporarily or permanently, without prior notice or explanation. This includes prohibiting users from accessing or using the application.

2.4 Devices and Network

To ensure the stability of Well-Fixed Mobile, users must have an active internet connection through their network provider. As a result, mobile network providers may charge users for network connectivity services while accessing the application, and third-party fees may also apply. Users are responsible for any such costs incurred. Additionally, the mobile device or portable equipment used must meet the specified requirements or be authorized for access and use of Well-Fixed Mobile.

2.5 License to Use Well-Fixed Mobile

Users must pay the required service fees to download and use Well-Fixed Mobile. Upon payment, users are granted a license to use the application.

2.6 License to Use Content

By recording or uploading any data or images (hereinafter referred to as “Content”) via Well-Fixed Mobile, users confirm that they own the content or have obtained proper authorization from the content owner to use, reproduce, and store such content. Users also grant the company a non-exclusive, royalty-free, worldwide license to use the content for the promotion of products or services.

2.7 Third-Party Content

Well-Fixed Mobile may contain links to third-party websites or applications (“Third-Party Websites”). Users acknowledge that Third-Party Websites are beyond the company’s control and agree that the company is not responsible for, nor does it endorse or review, the content or privacy policies of such websites (if applicable). The company disclaims any liability for losses or damages users may incur from accessing or using Third-Party Websites.

3. Terms and Conditions of Service

3.1 User Acknowledgment

The user confirms that they are of legal age to enter into a binding contract and agree to be bound by these Terms and Conditions. If the user is an employee or representative of a business entity or other legal entity and is using the WellFixed Mobile app on behalf of such entity, the user represents that they have the authority to use the WellFixed Mobile app as a representative of the entity and accept these Terms and Conditions on behalf of that entity.

3.2 Accuracy of Information

The user warrants that all information provided during registration and as part of their account is true, complete, and accurate. The user agrees to notify the company immediately of any changes to such information by updating their account details.

3.3 Prohibited Use of the WellFixed Mobile App

The user unconditionally agrees not to use or permit others to use the WellFixed Mobile app for the following purposes:

3.3.1 Transmitting or receiving content that is false.

3.3.2 Sending or receiving content that is threatening, aggressive, obscene, pornographic, harassing, defamatory, or violates confidentiality, copyrights, personal rights, rights to publicity, privacy rights, or the rights of third parties.

3.3.3 Transmitting or receiving any content without necessary authorization and/or approval (from the company or third parties) or engaging in activities that constitute a criminal offense, result in civil liability, violate the law, or infringe upon the rights of third parties in any jurisdiction.

3.3.4 Transmitting or receiving content that is technically harmful, including but not limited to computer viruses, logic bombs, Trojan horses, worms, malicious components, corrupted data, malware, or harmful software.

3.3.5 Causing unnecessary annoyance, inconvenience, or anxiety.

3.3.6 Intercepting or attempting to intercept communications transmitted through telecommunications systems.

3.3.7 Using the app for any purpose beyond those specified by the company or outside the intended purpose of use.

3.3.8 Engaging in fraud or corruption.

3.3.9 Using the app in a manner that violates accepted internet practices or network usage guidelines.

3.3.10 Encouraging racial, religious, or ethnic hatred or harming individuals, groups, or legal entities.

3.3.11 Taking actions that cause an unreasonable or excessive load on the company’s system infrastructure.

3.3.12 Reselling or reproducing the app.

3.3.13 Providing false information, including fake names, addresses, and contact details, or using fraudulent credit/debit card numbers.

3.3.14 Attempting to bypass the company’s security systems or networks, including accessing unauthorized data, logging into unauthorized servers or accounts, or testing the security of other networks (such as port scanning).

3.3.15 Engaging in any form of network monitoring that intercepts data not intended for the user.

3.3.16 Conducting fraudulent transactions with the company or merchants (including transactions falsely claimed to be on behalf of third parties without authorization or misrepresenting oneself as a third party).

3.3.17 Extracting data from or hacking into the WellFixed Mobile app.

3.3.18 Engaging in illegal activities related to the use of the WellFixed Mobile app.

3.3.19 Participating in any activity that, in the company’s sole opinion, restricts or prevents other customers from using or benefiting from the WellFixed Mobile app.

3.3.20 Using the WellFixed Mobile app in violation of these Terms and Conditions.

4. Rules for Using the WellFixed Mobile App

4.1 Error Corrections

The company will make reasonable efforts to correct any errors or omissions as soon as possible after being notified. However, the company does not guarantee that the WellFixed Mobile app will be error-free and shall not be liable for any errors, faults, or omissions.

4.2 Service Availability

The company does not guarantee uninterrupted use of the WellFixed Mobile app. It does not warrant that data transmitted through the app will always be accurate, secure, or immediate. While the company will strive to provide continuous access to the WellFixed Mobile app, access may be suspended, restricted, or terminated at any time.

4.3 Security and Viruses

The company does not guarantee that the WellFixed Mobile app will be free from viruses or other elements that may harm technology.

4.4 Changes, Maintenance, and Service Restrictions

The company reserves the right to modify, amend, replace, suspend, or remove any data or services in the WellFixed Mobile app at any time without prior notice. Additionally, user access may be temporarily restricted to allow for repairs, maintenance, or the introduction of new support features or services. The company will endeavor to restore access as soon as possible. Furthermore, the company reserves the right to remove any data or services from the WellFixed Mobile app at any time.

4.5 Content Moderation and Access Restrictions

The company reserves the right to restrict access and/or modify or remove any content that it deems, at its sole discretion, to be in violation of these Terms and Conditions.

6. Disclaimer and Limitation of Liability

6.1 “As-Is” Provision

The WellFixed Mobile app, the information contained within it, and all related facilities are provided on an “as is” and “as available” basis, without any express or implied warranties.

6.2 Warranty Disclaimers

The company disclaims all representations and warranties regarding the WellFixed Mobile app and its content, including but not limited to any inaccuracies or omissions within the app. This includes warranties of merchantability, fitness for a particular purpose, quality, accuracy, availability, non-infringement, or any implied warranties arising from trade usage or commercial practice, to the extent permitted by applicable law.

6.3 No Guarantee of Uninterrupted Access

The company does not guarantee uninterrupted, fast, secure, or error-free access to the WellFixed Mobile app. It does not warrant that the app will be free from computer viruses, harmful code, or other security threats. Furthermore, the company is not responsible for disruptions caused by force majeure events, including but not limited to natural disasters, lack of content, telecommunications failures, or IT infrastructure issues.

6.4 Force Majeure

The company shall not be liable for any failure or delay in performing its obligations under these terms due to circumstances beyond its reasonable control, including failures of public or private telecommunications networks.

6.5 No Liability for Third-Party Actions

The company shall not be responsible for any actions or omissions of third parties, regardless of how they arise. It shall not be liable for direct, indirect, incidental, special, consequential, or punitive damages related to:

The use or inability to use the WellFixed Mobile app.
Reliance on or downloading from the app.
Delays, inaccuracies, or transmission errors.
Business losses, lost profits, lost data, or any intangible losses—even if the company has been advised of the possibility of such damages.

6.6 No Contractual or Tort Liability

The company shall not be liable under contract, tort (including negligence), or any other legal theory for any indirect, consequential, incidental, special, or punitive damages resulting from the use of the WellFixed Mobile app. For the purpose of this agreement, indirect or consequential damages include, but are not limited to:

Loss of revenue, profit, savings, or anticipated business opportunities.
Loss of data, goodwill, or usage of devices, including apps.
Third-party claims and related fees or expenses.

6.7 Legal Compliance

The above exclusions and limitations apply only to the extent permitted by law. They do not affect statutory rights that cannot be excluded or limited under consumer protection laws.

6.8 Data Security and Electronic Communications

While the company strives to maintain a secure system, the user acknowledges that all electronic data transmissions may be intercepted. The company does not guarantee that data transfers via the WellFixed Mobile app or emails sent to or from the company will not be monitored or accessed by third parties.

7. Indemnification

The User agrees to indemnify and hold harmless the Company from any claims, lawsuits, legal actions, or proceedings that may be filed or initiated against the Company arising from or related to:

(a) The User’s use of the services;
(b) Any third party using the services under the User’s identity, PIN, or account information as designated by MB Tech Co., Ltd.; and/or
(c) The User’s violation of these Terms and Conditions.

The User further agrees to compensate the Company for any damages, costs, and interest incurred as a result of such claims, lawsuits, legal actions, or proceedings.

8. Intellectual Property Rights

8.1 Advertising Content, Information, Photographs, Illustrations, Artwork, and Other Graphic Materials
The advertising content, information, photographs, illustrations, artwork, and other graphic materials, as well as trademarks, logos, and trade names within the Well-Fixed Mobile app, are protected under copyright laws, other applicable laws, and/or international treaties. These are the property of the Company and/or its suppliers (as applicable). Copying, reproducing, distributing, broadcasting, publishing, or disseminating the work, trademarks, graphics, sound, or images, whether in whole or in part, is strictly prohibited unless explicitly authorized by the Company and/or its suppliers (as applicable).

8.2 Trademark License
Nothing in the Well-Fixed Mobile app shall be construed as granting the User an implied license or right to use any trademarks, logos, or other intellectual property appearing within the app. The User is expressly prohibited from using the trademarks or any other content from the Well-Fixed Mobile app in any manner that is unlawful or unauthorized.

8.3 Legal Action for Unauthorized Use
The Company reserves the right to take immediate legal action against any unauthorized use of its trademarks, names, or logos to protect and maintain its intellectual property rights. The Company also reserves all rights not expressly granted in these Terms and Conditions. Product names and company names mentioned in these Terms and Conditions may be trademarks of their respective owners.

9. Updates and Amendments

9.1 Changes to Content
The Company may modify the content of the Well-Fixed Mobile app, including the details and prices of products and services advertised, at any time without prior notice. The Company will not be held liable for any errors or omissions in the app’s content.

9.2 Amendment of Terms and Conditions
The Company reserves the right to change or amend these Terms and Conditions from time to time without prior notice to the User. Updated Terms and Conditions will be displayed in the Well-Fixed Mobile app and will take effect immediately upon posting. The Company advises Users to regularly review these Terms and Conditions as they will be binding.

10. Governing Law and Jurisdiction

10.1 Applicable Law
The User acknowledges that the Well-Fixed Mobile app can be accessed from any country where local technology allows it. Due to varying laws in different countries, both the User and the Company agree that the laws of Thailand shall govern any and all matters related to the use of the Well-Fixed Mobile app, excluding any conflict of law principles.

10.2 Jurisdiction
The User agrees and submits to the exclusive jurisdiction of the courts of the Kingdom of Thailand for any disputes arising from or related to these Terms and Conditions.

We may update this policy from time to time. The latest version will always be available on our website.
